This Disclosure Text is hereby informed by Özak Gayrimenkul Yatırım Ortaklığı Anonim Şirketi (“Company”), acting as the data controller, regarding your personal data processed/collected automatically through the form on our website, provided that it is part of a data recording system, within the scope of the “Data Controller’s Obligation to Disclose” in accordance with Article 10 of the Personal Data Protection Law No. 6698 (“KVKK”).

1. Purpose and Legal Reason for Processing and Transferring Your Personal Data
   1. Your personal data in the form of your name, surname, e-mail address, telephone number, message and the data you have written in the "Where did you hear it from?" section, and your personal data to be obtained during our communications and interactions with you and by filling out the appointment form, are processed in order to meet your request through the contact form, based on the legal grounds that it is necessary for the performance of a contract and the establishment of a right in accordance with Article 5/2 of the KVKK.

Your personal data in the form of your name, surname, e-mail address, telephone number, and your personal data to be obtained during our communications and interactions with you, in case of your approval in accordance with the Law on Regulation of Electronic Commerce and your explicit consent in accordance with Article 5 of the KVKK;

Your Personal Data is shared with Emlak Konut Gayrimenkul Yatırım Ortaklığı A.Ş., its subsidiaries and affiliates, for the legal reason that it is necessary for the establishment and execution of the contract in accordance with Article 5/2 of the KVKK, for the signing of contracts due to the joint execution of projects and the fulfillment of obligations arising from the contract.
   3. Your personal data is shared with domestic and international persons and organizations that process data, provide measurement, targeting and profiling support, advertising and promotion agencies, CRM companies that provide services, service providers for sending SMS and e-mails, call centers for making calls, domestic and international software companies, servers and service providers to carry out our activities, and Message Management System Inc., based on your explicit consent, in order to fulfill the above-mentioned purposes and activities.
   4. Your personal data is transferred to "Authorized Public Institutions and Organizations" for the purpose of fulfilling our obligations regarding information and document sharing arising from the relevant legislation, based on the legal grounds that it is clearly prescribed by law and fulfilling a legal obligation within the scope of Article 5/2 of the KVKK, and for the purpose of exercising our legal and administrative rights, based on the legal grounds that it is necessary for the establishment and protection of a right within the scope of Article 5/2 of the KVKK.
   5. Your personal data is shared with our “Group Companies”, “Affiliates” and “Partnerships” (primarily Özak Ziylan Yenigün Adi Ortaklığı, Özak Global Holding A.Ş., Akyön Tesis Yönetim Hizmetleri A.Ş., Kamer İnşaat Ticaret ve San. A.Ş., Ela Hospitality Turizm ve Otelcilik A.Ş.) based on the legal grounds of the data controller’s legitimate interest and its necessity for the establishment and execution of the contract in accordance with Article 5/2 of the KVKK, in order to fulfill the obligations set forth in the Turkish Commercial Code and the provisions of the contracts made between the companies that are the subject of the Group of Companies or are included in the Group of Companies and to provide our services.
   6. In relation to our activities, personal data is shared with our "Suppliers" and "Business Partners" from whom we receive services, limited solely to the purpose of fulfilling contracts made for obtaining necessary external services. In this context, for example, your personal data may be shared: With Financial Advisors from whom we receive services due to financial obligations, based on the legal grounds of necessity for the performance of a contract pursuant to Article 5/2 of the Personal Data Protection Law (KVKK), With Lawyers from whom we receive legal services in the event of a legal dispute, based on the legal grounds of necessity for the establishment and protection of a right pursuant to Article 5/2 of KVKK, With "Software Service Providers and Data Processors" from whom we receive software services to operate, develop our systems and improve our service quality, based on the legal grounds of performance of a contract and legitimate interest of the data controller pursuant to Article 5/2 of KVKK, And with Auditors, in case of audits, limited only to the data categories required by the operation, based on the legal grounds of necessity for the data controller to fulfill its legal obligations pursuant to Article 5/2 of KVKK.
3. Collection Method:

Your personal data is processed by automatic and non-automatic methods, including direct communication, targeting, profiling, online behavioral advertising, and digital forms on our website, digital marketing technology tools, call center, mobile application, e-mails, social media channels and our sales and marketing representatives.

You can submit your requests within the scope of Article 11 of the Law, which regulates the rights of the relevant person, in writing in accordance with the "Communiqué on the Procedures and Principles of Application to the Data Controller" or by using the registered electronic mail (KEP) address, secure electronic signature, mobile signature or the electronic mail address previously notified by you and registered in our system.
